1. Purpose and acceptance

These terms of use (the “Terms”) govern:

  • Part I — access to and browsing of the SugarFriend website (the “Website”);
  • Part II — use of the SugarFriend mobile application (the “Application”),

both published by SAS LSDP Le Secret du Poids (30 rue Tiphaine, 75015 Paris, France, SIREN 803 445 584, Paris Trade and Companies Register), represented by its President Florence Delorme — see the Legal notice (in French).

By browsing the Website, you accept Part I. You are also asked to accept these Terms when you create your account in the Application. If you do not accept them, you must not use the Website or the Application.

Part I — The Website

2. Access to the website

The Website is accessible free of charge, without creating an account, to anyone with Internet access. Network access costs remain your responsibility.

The publisher endeavours to keep the Website continuously accessible but undertakes no obligation of permanent availability: access may be interrupted at any time, in particular for maintenance, updates or any other technical reason, without the publisher incurring any liability.

3. Website content — non-contractual information

The information published on the Website (Application features, launch schedule, screen visuals) is provided for information and promotional purposes. It describes an application under development and is subject to change. It constitutes neither a contractual offer nor a commitment that specific features will be available on a specific date.

4. Liability (Website)

The publisher endeavours to keep the information on the Website accurate and up to date, without guaranteeing that it is free of errors or omissions. The publisher cannot be held liable for:

  • damage resulting from the inability to access the Website or from its interruption;
  • direct or indirect damage resulting from the use of information on the Website;
  • malfunctions attributable to your equipment, your connection or third parties;
  • the content of third-party websites accessible through links from the Website (see section 5).

You undertake to use the Website in accordance with its purpose, applicable regulations and these Terms, and not to interfere with its operation (in particular: intrusion attempts, bulk extraction of content, use of robots for purposes other than indexing by search engines).

5. Hyperlinks

Outbound links: the Website may contain links to third-party websites (in particular to the Application's listings on the App Store and Google Play). The publisher has no control over these websites and declines all liability for their content and practices.

Inbound links: a simple link to the Website's home page may be set up freely, provided it does not harm the image of the publisher or the SugarFriend brand, creates no confusion as to the origin of the content, and does not originate from a website that is unlawful or contrary to public decency. The publisher reserves the right to request the removal of any link. Any framing or inline-linking technique reproducing content from the Website is prohibited without prior written consent.


Part II — The Application

6. The service

SugarFriend is a service that connects adults for friendly outings: a “Sugar” member suggests an outing (a “Sugar Invite”) and pays all of its costs; a “Friend” member asks to join and, if selected, takes part in the outing. A member may hold both roles.

SugarFriend is neither a dating service, nor a “sugar dating” service, nor a ticketing service. No consideration is expected from or owed by the Friend. The Sugar's payment of the outing's costs constitutes neither remuneration for a service nor payment for anyone's presence or company. Participants simply take part in a shared activity.

7. Eligibility — 18 and over

The Application is strictly reserved for adults (aged 18 and over). Your date of birth is requested when you create your account; any account created by a minor or on behalf of a minor will be deleted. Each person may hold only one account, created under their real identity (other members see your first name and the initial of your last name).

8. Outings and costs — limited role of the publisher

  • No money is paid by the Sugar to the Friend. The payment covers exclusively the costs of the proposed outing or activity and does not entitle the Sugar to any service or favour from the Friend.
  • The Sugar pays all the costs of the outing they suggest (meal, activity, tickets…). This payment takes place outside the Application: the publisher does not collect, hold in escrow or transfer any money between members, is not involved in these expenses and guarantees neither their amount nor their performance.
  • The only payments made for the service are the subscriptions taken out through the App Store or Google Play (see section 13).
  • The publisher is a technical intermediary: it is not a party to the relationships formed between members or to the outings organised, and cannot be held liable for members' behaviour, online or during outings.

9. Prohibited uses

The following are strictly prohibited and lead to the removal of the content concerned and the suspension or deletion of the account, without prejudice to legal proceedings:

  • making the payment of an outing conditional on a favour, a service, a romantic or sexual relationship, a personal commitment or any other service from another member. It is also prohibited to offer, solicit or accept any payment between members in exchange for presence, company or a favour, including in the form of escort services, prostitution or “sugar dating”. Taking part in a SugarFriend activity does not constitute consideration for the payment of that activity's costs;
  • using the Application for commercial, advertising or canvassing purposes;
  • unlawful, hateful, discriminatory, defamatory, obscene, pornographic or violent content and behaviour, or content inciting violence;
  • harassment, threats or intimidation of other members;
  • identity theft, fake profiles, false profile information (in particular about age);
  • collecting other members' data, spam, use of robots or automated means;
  • any interference with the operation or security of the Application.

10. Member content and moderation

You are solely responsible for the content you publish (photos, invites, messages, reviews). By publishing it, you grant the publisher a licence to use it, limited to the operation of the service.

The publisher reserves the right to remove any content contrary to these Terms or to the law and to suspend or delete its author's account. Moderation relies on:

  • reporting by members (see section 11);
  • review of reports by the moderation team through a dedicated administration interface.

11. Reporting and blocking

  • Report: any profile, any Sugar Invite and any message can be reported directly from the Application. Each report is reviewed by the moderation team as soon as possible and gives rise to appropriate measures (removal, warning, suspension, deletion).
  • Block: you can block any member; blocking cuts off your messaging with them, removes them from your discovery feed and prevents any invitation between you.

12. Reviews between members

After an outing, each participant may leave a review of the other (ratings and comment). The average rating is public on the profile; the detail of reviews remains private. Only one review per pair and per shared outing is possible. Reviews are subject to the rules of section 9 and may be reported and moderated under the same conditions.

13. Subscriptions

Some features are accessible through a paid subscription, taken out exclusively through the App Store (Apple) or Google Play under the conditions displayed before purchase. Subscription management and cancellation are carried out from your App Store or Google Play account; the applicable renewal, refund and withdrawal conditions are those of these platforms, supplemented by the conditions displayed in-app.

14. Account deletion

You may delete your account at any time, directly in the Application (Settings → Delete account, with double confirmation). The effects of deletion on your data (immediate anonymisation, purge within approximately 30 days) and the possibility of requesting deletion without reinstalling the Application are described in the Privacy policy (in French).

Deleting the account does not, by itself, end an ongoing subscription: it must be cancelled from your App Store or Google Play account.

The publisher may, for its part, suspend or delete an account in the event of a breach of these Terms (see sections 9 and 10).


Common provisions

15. Intellectual property

The “Sugar Friend” trademark and the associated logo are registered trademarks (INPI, French trademarks no. 4640086 and 4640084; WIPO, international trademark no. 1926745), owned by Florence Delorme — see the Legal notice (in French). Any reproduction or use of the trademark or logo without the owner's prior written consent is prohibited.

All content of the Website and the Application (texts, illustrations, mascots, photographs, videos, visual identity, layout, code) is protected by copyright and, more generally, by intellectual property law. Any reproduction, representation, adaptation, extraction or reuse, in whole or in part, without the publisher's prior written consent, is prohibited and may constitute infringement (articles L.335-2 et seq. and L.716-4 et seq. of the French Intellectual Property Code).

Browsing the Website or using the Application does not transfer any rights to you.

16. Personal data

The processing of personal data relating to the Website and the Application is described in the Privacy policy (in French), which forms an integral part of the framework for using the service.

17. Changes to the Terms

The publisher may amend these Terms at any time. The applicable version is the one online on the date of your browsing or use; the date of the last update appears at the top of the document.

18. Governing law and disputes

These Terms are governed by French law. In the event of a dispute and failing an amicable resolution, the French courts shall have jurisdiction under the ordinary rules of law.
